A second factor in the eyes of the law is that you must establish
damages.
In other words, a young child who is incapacitated by medical
malpractice loses an entire lifetime of earnings, family life, and
joy.
A second victim, equally incapacitated at the age of 80 has less
damages. His life is pretty much behind him already.
Lots of the "lawsuits" come out of cases where there was extreme
neglect (by you, the patient) which certainly contributed to the
problem.
An example:
You have an abscess. You call your dentist immediately and undergo
root c{*filter*}therapy.
Case #2: You have an abscess but wait 4 1/2 weeks before you go to
your dentist.
In case #2, you have already experienced destruction of some of the
periodontal ligament. You have the root c{*filter*}therapy, but the tooth
fails 2 years later.
Assuming the root c{*filter*}treatment was successful, what is your
contribution to this?
