
dislocation changed my life
I once was treated in a similar fashion. When questioned by the
"judge" as to what "dystraction" was, the doctor admitted it was
actually dislocation. And on top of that he wanted to charge me for
causing me additional injury and trauma.
Below is my spoken statement to the court about the incident of which
I prevailed.

Your Honor:
I have very good reason to believe that this man, Dr. XXXXX XXXXXX,
took advantage of me and the condition I suffered from as a result of
being involved in two auto accident's caused by someone else.
He took advantage of my need, my personality, and my lack of knowledge
about any special health care concerns.
I had always thought that doctor's of any type deserved respect of
their professional position. I was raised this way. Doctor's are
educated about diseases and there treatments and I am not a doctor.
Dr. XXXXXX took advantage of what he had reason to believe being
beyond my level of knowledge. He knew that I didn't have any special
training or awareness of matters concerning the temporomandibular
joints. I was just an everyday hard-working guy who was injured while
innocently using my truck. My expertise is in matters of building
construction and more specifically plumbing. I was a journeyman
plumber for 20 years prior to this and can no longer perform my normal
and customary work.
He knew that I was very concerned about not being able to work and to
provide for my family because of my health. He knew I would be
compliant with his treatment plan because I needed to get well.
At no time did he educate me as to the many well known and documented
controversies surrounding this malady called TMJ.
He did'nt explain that there is tremendous abuse of the general public
and it's resources when it comes to care and treatment of TMJ. These
controversies were not generally known to people like me. He should
have known that and brought it to my attention.
Furthermore, I believe Dr. XXXXXX probably takes advantage of the
general public all the time. He advertises on the window of his office
that he provides TMJ Treatment.
I have learned a lot about this thing called TMJ as a result of Dr.
XXXXXX and others abuse of my situation. First of all, TMJ is not a
diagnosis. If he means that he treats the TMJ I do not believe he
provided me with care which was appropriate if he treated me for a
non-existant condition commonly called TMJ. I didn't know that was the
case while I was under his care.
As soon as I came to know this I never returned to his office.
I believe that Dr. XXXXXX committed fraud against me and others and I
do not believe that he is entitled to this money which he is suing me
for in this court today.
He failed to properly follow my progress, failed to refer me to
someone more knowledgable about chronic conditions of jaw dysfunction
secondary to traumatic injury and he may be unqualified to recognize
the actual problems which I suffered. I believe he has contributed to
my pain and suffering. He has caused me to suffer serious emotional
damages for which I do not have the financial resources for needed
care. It is not entirely clear how much physical and emotional damages
he has caused me but, doctors who steal from the sick are thieves of
the worse kind. If the court allows him to be further compensated for
what I believe to be fraudulent and professionally negligent care I
will suffer additional damages. I pray that this court review all the
materials I have provided which support my position.
