HC upholds AIIMS director's extension

Delhi High Court on Friday upheld the second-time
extension given to Dr PK Dave as the Director of the All
India Institute of Medical Sciences.
A Division Bench, comprising of acting Chief Justice
Devinder Gupta and Justice A K Sikri, dismissed a
petition filed by an NGO, Health India, challenging the
second-time extension given to Dr Dave beyond the age of
60 years. The Bench said the director was given an
extension in 2001 and his (Dr Dave's) term was going to
end very soon.
The judges left it open to the authorities to decide as
to whether extensions could be given beyond the age of 60
years for administrative post like director. The Bench
observed that during the hearing of the petition it had
been shown in the form of a chart that previous directors
also had been given extensions beyond the age of 60
years.
The petitioners had argued that though an outgoing
director was eligible for re-appointment, the new
appointment had to be made after following a laid down
procedure of appointment. A procedure which the
petitioners had said was not followed in the case.
Appearing for the petitioners, advocate B K Sinha said
that as per the AIIMS Act, for the process of re-
appointment, the Institute Body had to select a candidate
and forward the name to the Centre for approval. His
contention was that the IB had not approved the re-
appointment of the director. The Bench, however, said
that as per records, the minutes of the IB meeting showed
that it had, in fact, approved the extension.
Dr P K Dave was appointed as the director in October 1996
on a five-year term till the age of 60 years expiring on
June 1999. But in April 1999, he was given the first two-
year extension by the Government till he reached the age
of 62 years. Another two-year extension was given
thereafter in June 2001 for the term expiring in June
2003.
Appearing for the respondents, the Additional Solicitor
General said the concept of superannuation didn't apply
to a tenure post such as director.
